Social Security uses what is called the “fee agreement process” to pay representatives who help Claimants. For those signing an appropriate fee agreement Social Security will approve the agreement and pay the representative up to 25% of a retroactive fee. SECRET JUDGE PROGRAM TO END APRIL 20
Naturally, just as the print copy of my Spring 2013 newsletter, Social Security & You, went to press it was announced that the SSA policy of not disclosing the identity of the Administrative Law Judge until the Claimant appeared at the ODAR will be reversed beginning April 20.
Freedom of Information requests were successful in forcing SSA to divulge the identity of the ALJ in advance of the hearing and members of Congress responded to complaints from constituents by pressuring the agency to reverse the policy.
